The president of the General Council of Notaries and dean of the Illustrious Notarial College of Madrid, Concepción Pilar Barrio del Olmo, has defended that rents be formalized in a public deed to give greater "legal certainty" to both the tenant and the owner.
This was indicated during the Housing and Urban Agenda Commission this Tuesday in the Congress of Deputies, in which he appeared to report on the statistics portal of the General Council of Notaries, together with the general director of the Technological Center of Notaries (CTNotariado), Alberto Martínez.
In it, Barrio del Olmo regretted that in Spain there is no custom of formalizing rents in a public deed, which would allow to have data on rents in an exercise of "transparency and information".
"We are talking about people's homes, I don't care if they are owned or rented. The intervention of the notary will guarantee, as in any operation in which we intervene, the capacity of the parties, the identity, the control of legality that whoever rents is really the owner and can rent," he defended.
In this sense, the president of the General Council of Notaries has assured that this public deed system would also serve to control seasonal rental contracts, with the aim of verifying whether they are fraudulent or not, and if they are using this modality to circumvent the Urban Leases Law (LAU).
"The notary could easily control the cause of that contract and, in addition, all this in a very simple way, with a very short contract that we would have posted on our electronic headquarters, what we call the citizen's portal," he detailed.
"We would control the legality, at the moment of truth, at the moment that the keys are handed over and the rent is paid and the deposit is deposited, where appropriate, because a subsequent control only leads to pathologies, to a trial, with the costs that we know it entails, both economic and emotional," he added.
In addition, Barrio del Olmo has assured that the cost of this notarial intervention will depend on the Government, which marks what notaries charge.
Regarding the new statistical portal, which will be available on October 21, the notaries have indicated that it is a real estate portal moving forward based on authentic data, on sales and mortgages, which uses artificial intelligence and with "greater information and granularity" about the home.
On the other hand, during the appearance, the general director of the Technological Center of Notaries has indicated that the increase in housing prices differs by territories, with differences in prices of up to 31% in Madrid and 50% in Barcelona between the capital of the province and the province.
For this reason, he has advocated for "quality" public transport that connects the city with municipalities where the price of housing is lower in a maximum of 45 minutes. However, he acknowledged that this solution is complicated in other stressed areas, such as the island territories of the Balearic Islands or Mallorca, where the price between the capital of the province and the province is practically the same and the situation is more "complex" because it is not possible to "reclaim land from the sea".
In relation to house prices, he indicated that in the last six months the level of 2007 has been recovered in nominal terms, while in real terms it is 27% below, with differences between territories. Thus, he stressed that the housing problem occurs in "certain areas".
Regarding sales, he explained that in the last year 723,000 operations have been carried out, of which only 63,000 were for new homes, which shows the lack of newly built properties.
